Elopement Contract - Park


This agreement is made between My Dream Ceremony (“Officiant”) and Signers (the "Couple") (individually, a “Party,” and collectively, “The Parties”) to officiate a marriage ceremony ("Ceremony") on at at the location of the Park - 163 Monument Pkwy, Perris CA 92570.

Ceremony. The Elopement ceremony package service totals $149.99 (retail $199.99). Ceremony includes a marriage ceremony maximum running time of five (5) minutes (No procession. No set-up or chairs. No music), an English and/or Spanish, ceremony at the office, fifteen (15) minute ceremony planning session, day-of-coaching, and submission of marriage license (if applicable) to corresponding County Recorder's office.

Ceremony Time. Running time of five (5) minutes maximum. Unities are not included in this package. 

Language(s). Services are provided in Spanish, English, and/or Spanglish. The Officiant does not impose additional charges for conducting ceremonies in Spanish. However, any materials provided by the Couple must be in the Ceremony’s intended language. The Officiant does not offer translation services for any written dialogue.

Mileage/Travel. There is no travel with this package.

Ceremony Planning Session. The Couple is entitled to a complimentary fifteen (15) minute consultation with the Officiant to discuss the Ceremony details. This session may be conducted via webcam, phone, or in-person at 3388 Cabrillo Court, Perris, CA 92570. If the Couple prefers an alternate location for the meeting, it will be at the Officiant’s discretion and subject to availability and additional costs.

Day-of-coaching. The Officiant provides day-of coaching exclusively for the Couple. Any coaching for guests, vendors, or the wedding party is not included unless specifically stated in this contract.  

Guest Limit. There is maximum of two (2) guest are permitted (including children) due to office space. No exceptions. However, the Couple agrees to adhere to all regulations set forth by County and State authorities, which may include restrictions on the number of guests. Non-compliance by the Couple may result in the Officiant’s refusal to provide services, and any payments made will be non-refundable as a cancellation by the Couple.

Rehearsal. No rehearsal is included in the package, it is the Couple’s responsibility to guide and coordinate the bridal group on the day of the Ceremony. If the Officiant must step in to assist the wedding party due to, for example, poor planning on behalf of the Couple, a one hundred dollar ($100) fee will apply and be payable at that time. Officiant advises the Couple to invest in a rehearsal if in doubt. This service and fee will only apply with the consent of the Couple prior to surrendering services.

Marriage License. The Couple agrees that is it their responsibility to secure and present a valid Marriage License and government-issued identification on the day of the Ceremony. Should these documents not be provided, the Ceremony will be symbolic only and will not create a legally binding marriage in the State of California. Failure to present the Marriage License to the Officiant means all legally-binding language, such as, but not limited to, "marriage," "husband," "wife," "married," "wed," "newlyweds," "Mr. and Mrs.," "Mr. and Mr.," and "Mrs. and Mrs." will be struck from the ceremony and replaced with non-legal words such as "union," "commitment," "partners," etc. The Couple may arrange for a private legal Ceremony at a later date for an additional fee of one hundred  dollars ($100), payable upon scheduling the legal Ceremony. The Couple is also responsible for providing (if applicable) the necessary witness(es) for the signing of their marriage license.

The Officiant is tasked with filing the marriage license with the United  States Postal Service (“USPS”) as per California Family Code Section 359(f). The Couple may not file the marriage license themselves as legal responsibility of filing the marriage license is put on the Officiant by California Family Code Section 359(e).

Should the marriage license be rejected or not received by the County Clerk, the Officiant will collaborate  with the Couple to rectify the issue. The Couple will bear the costs for any amendments or replacement of the marriage license due to erasures, white-outs, stains, tears, or other alterations will be assumed by the Couple. The Officiant will assume the cost of the amendment or replacement marriage license only if there is an erasure, strikeout, white-out, tear, or stain in the Certification of Person Solemnizing Marriage section on the corresponding boxes (public license: boxes 28A through 29E; confidential license: boxes 27A through 28E) on the marriage license.

No discount will be given if the Couple does not need the Officiant to complete the marriage license information (e.g., for a non-legal commitment Ceremony or renewal of vows).

Reservation Fee. A NON-REFUNDABLE reservation fee of fifty percent (50%) of the base package price as listed on this contract must be provided at the time of booking, along with a confirmation from the Officiant to guarantee the wedding Ceremony’s date and time. The remainder of the balance must be paid in full by midnight (12:00 a.m. PT) seven (7) days before Ceremony date. Failure to pay in full before agreed-upon date will result in a twenty-five dollar ($25.00) per day late fee until the wedding date, OR the Ceremony agreement being revoked. All fees must be paid prior to Ceremony being performed.

Refunds. No refunds, including for retainers, are given. Exceptions may be made by the Officiant if the Officiant is able to re-book the Couple’s wedding. Providing exceptions is of the sole discretion of the Officiant and is heavily dependent on the Officiant’s availability.

Merchant Fee. Refunds for accidental payments may not, to no fault of My Dream Ceremony, include fees associated with orders placed by merchants.

Acceptable Forms of Payments. Officiant accepts either cash or debit/credit card as a form of payment. No checks are accepted, and no exceptions will be made. Payment may also be accepted over the phone by calling (909) 489-1022. It is the responsibility of the Couple to make sure the payment is accepted. A receipt will be given to Couple upon payment received.

Change to Ceremony Reservation. The contract may be cancelled or amended due to changes, however, any change to time, date, or location must be disclosed at least thirty (30) days in advance and approved by the Officiant. If circumstances cause the Couple to postpone the Ceremony to another date, the Officiant will make every attempt to accommodate the new date (based on availability). Couple's monies paid to date will be transferable if the new date is within six (6) months of the original date, and postponement is notified to the Officiant via email within thirty (30) days prior to the wedding date. Couple may bear any extra costs associated with rescheduling. If Officiant cannot accommodate the new date, then the Officiant will make its best effort to find another Officiant. However, if changes to the Ceremony are made which the Officiant cannot accommodate due to other obligations, Couple is responsible for finding a new officiant as well as paying any and all fees to the new officiant. If the Couple does not want to use the services of the replacement officiant, all monies paid will be forfeited.

Delayed Ceremony Fees. The Couple has fifteen (15) minutes from the scheduled time to start the Ceremony. If, by no fault of the Officiant, the Ceremony starts fifteen (15) minutes or more after the Ceremony time for any reason including, but not limited to, weather, delays caused by other vendors, or the late arrival of guests or wedding party, a late fee of twenty-five dollars ($25.00) for every fifteen (15) minute increment will be incurred by the Couple until the Ceremony starts. These fees are due prior to the Ceremony’s start, or no Ceremony will be performed. If an excessive delay affects the Officiant’s ability to remain on-site due to prior commitments, the couple will not hold the Officiant liable for the Officiant’s inability to conduct the Ceremony. 

Marriage Vows. The Couple understands that this is a scripted ceremony in the language of their choosing (Spanish or English). 

Photo/Video Release. The Couple permits Officiant’s use of images and videos from any portion of the ceremony day for display, publication, or other promotional uses without compensation to the Couple. For the duration of the Ceremony day, the Couple’s guests shall be deemed to have consented to the use of their name, image, video, and likeness by the Couple and Officiant. Additionally, the Couple shall defend and indemnify the Officiant from any claims that any of the Couple's guests may assert against the Officiant arising from or related to the use of any name, image, video, or likeness of the Couple's guest(s) by the Officiant. The Officiant will publicly attribute photographer or videographer credit if provided by the Couple. The Couple must notify the Officiant via email (carla@mydreamceremony.com) if they do not want photos or video used. The Officiant will reply via email, and this reply will serve as acknowledgment that photos or videos will not be used.

Discrepancy. In the event of a discrepancy regarding services of the Officiant, the Couple must submit a full written report to My Dream Ceremony within thirty (30) days of the ceremony’s completion in order for the Parties involved to reach a mutually acceptable resolution. A mediator will be used should both Parties continue to disagree. Furthermore, the Couple agrees to refrain from posting negative reviews on the Internet (or elsewhere), or from making negative verbal or written statements regarding the Officiant’s services until all efforts to resolve said discrepancy have been exhausted.

Limited Liability Cause. The Officiant shall not be liable for any consequential, special, or indirect damages arising out of this agreement. In no event shall the maximum liability hereunder exceed the amount actually paid to Officiant under this contract. 

Governing Law. This Agreement shall be construed in accordance with the laws of the State of California, excluding its conflicts of law provisions. The Parties hereby irrevocably consent to the exclusive jurisdiction of the federal and state courts located in Riverside County, California, in connection with any action or proceeding arising out of or relating to this Agreement or any document or instrument delivered pursuant to, in connection with, or simultaneously with this Agreement. Any such action, suit, or proceeding must be brought only in the appropriate state or federal court located in Riverside County, California. And each Party covenants and agrees not to assert, by way of motion, as a defense, or otherwise, in any such action, suit, or proceeding, any claim that such Party is not subject personally to the jurisdiction of such court, that such Party’s property is exempt or immune from attachment or execution, that the action, suit, or proceeding is brought in an inconvenient forum, that the venue of the action, suit, or proceeding is improper, or that this Agreement or the subject matter hereof may not be enforced in or by such court.

Severability. In the event that any term of provision of this Agreement is held to be invalid, illegal or unenforceable in any respect, the remaining terms and provisions of this Agreement shall not in any way be affected or impaired thereby.

Force Majeure Clause. In the event of unforeseen circumstances beyond the control of either party, such as natural disasters, acts of war, pandemics, epidemics, or other major disruptions ("Force Majeure Events"), which may render the performance of this contract impossible or illegal, either Party shall be excused from performance without liability. Upon occurrence of a Force Majeure Event, the affected Party shall notify the other Party promptly, and both Parties shall engage in good faith efforts to reschedule the Ceremony or rehearsal to a mutually agreeable date.

Indemnification Clause. The Couple hereby agrees to indemnify and hold the Officiant harmless from any and all claims, losses, damages, or expenses, including reasonable attorneys' fees, arising from the Couple's breach of any terms in this contract or any negligent or wrongful act by the Couple or their guests during the Ceremony or rehearsal Ceremony.

Cancellation from Officiant. In the unlikely event that the Officiant is unable to perform the Ceremony for unforeseen reasons (i.e., hospitalization, auto accident, and/or transportation breakdown/disruption), Officiant will provide a replacement. Nevertheless, if an Officiant cannot be found, then Officiant will make a full refund of any deposit or payment made by the Couple. The Couple agrees that the refund will be the full extent of damages and no further damages may be sought against the Officiant or any persons affiliated with My Dream Ceremony.

Cancellation from Couple. This contract guarantees the Officiant’s availability for the Couple’s wedding date and time, thus preventing the Officiant from booking another wedding at the same date and time. If, for any reason, a decision is made not to use the services of the Officiant, the Couple must inform the Officiant in writing at carla@mydreamceremony.com at least thirty (30) days prior to the wedding date in order to release the Couple from this contract. If the Couple fails to provide such notice, the Couple assumes responsibility for the remaining balance due. Officiant will make every effort to come to a resolution, provided that the Couple communicates their concerns. Exceptions can be made if no business has been lost reserving the Couple’s wedding date.

IN WITNESS WHEREOF, the Parties hereto agree to the terms and conditions as described above and have caused this Contract to be signed on the dates indicated on this contract. The Parties agree that the specifics of the agreed ceremony shall be considered a part of this contract after signing.

Electronic Signature.
